Why is the extension motion important?
We are arguing for an EXTENSION MOTION so the court will continue to monitor that CDCr (CA Dept of Corrections) is in compliance with the Ashker settlement. Given CDCr has continued to violate the terms of the settlement and the constitutional rights of the prisoners represented in the class action lawsuit, it is necessary to have the settlement monitoring period extended. CDC wants the monitoring to end so they cannot be held accountable.

*The Ashker case is 4th for the court on its 9am calendar Wednesday. Please keep checking. It will probably be closer to 10 or 10:30am when our case is heard.

Join the Center for Constitutional Rights on Tuesday, May 12, 2020 as arguments are heard in the Ninth Circuit Court of Appeal on whether the state of California violated the settlement in our case, Ashker v. Governor, a federal class-action lawsuit on behalf of prisoners held in the Security Housing Unit (SHU) at California’s Pelican Bay State Prison who have spent a decade or more in solitary confinement.

Attorneys with the Center for Constitutional Rights will urge the court to uphold a ruling that California prisons have violated a landmark settlement agreement intended to end indefinite solitary confinement. The district court held that the California Department of Corrections and Rehabilitation (CDCR) violated the 2015 settlement by maintaining prisoners in levels of isolation equal to or even more severe than the isolation they experienced in the Security Housing Units (SHU).

“Security/Welfare Checks”: Call for 602s, 22s, and Artwork

Are you living in segregated housing (SHU, Ad-Seg, PSU, Condemned Units)?

Are correctional officers coming around to your cell every half hour or hour to conduct security/welfare checks?

Are these checks conducted in a quiet manner? Or do these checks disturb you? Do they interfere with your ability to sleep, or cause physical or mental health problems?

As you may know, the court in Coleman v Brown has ordered “security/welfare checks,” every 30 minutes in all solitary units as “suicide prevention.” The order does not direct how the checks should be conducted, only their frequency and location. The PHSS Committee to End Sleep Deprivation had hoped that the letters by many prisoners written since May 2016, to the Coleman Special Master and suicide expert explaining that the checks are disturbing their sleep and/or having a negative effect on their physical and mental health, would influence a change of the court order, but no such change has occurred yet.

The court has the authority to change the order for “security/welfare checks” (with Guard One System) in a number of ways. The PHSS Committee to End Sleep Deprivation, California Families Against Solitary Confinement (CFASC), and Family Unity Network realize that it is easier for court officials to ignore letters about the checks than to ignore 602s and written requests for medical or mental health treatment related to the checks.

If you are experiencing negative effects from the checks or from the way they are being conducted, it is time for the official record to reflect those effects. We hope that the attorneys for the prisoners in Coleman will take the 602s and medical requests seriously and address, with the court, the documented harms the checks are causing.

Past complaints resulted in the checks at the Pelican Bay SHU being reduced from every half hour to every hour at night (First Watch). Further reductions or other changes are possible there or at other prisons, but it will require new complaints being filed by a significant number of prisoners. Since the architecture and/or officer behavior in different segregated housing units can be different, it is important that a significant number of prisoners in each housing unit complain of these problems where they occur. The court is not likely to order statewide changes if there are problems at only a few prisons. The court is most likely to modify the order for those units where large numbers of people complain.

Prisoners often feel that filing 602s is pointless. It often seems that way. However, when prisoners act together, either by filing group 602s or by filing many 602s on the same issue in the same time period, that organized effort is heard. In contrast, courts interpret the lack of formal complaints as the lack of a problem.

We appreciate hearing from those who have already written us about this problem. Your responses to surveys, letters to the Coleman suicide expert and Special Master, and previous 602s about the checks have been important. The PHSS Committee to End Sleep Deprivation uses your words and information to spread awareness to the public, the legislature, and the media. We compile the information as an ongoing record.

If you have grounds to file a 602 and decide to file one, we recommend that you give your 602 to an officer with a CDCR Form 22 asking the officer to deliver the grievance to the Appeals Coordinator. The officer’s signature on the 22 form is your proof that you delivered your 602 for filing.

Please include in your 602: whether you are able to sleep while Guard One is in use; as many details as you can recall about how often you usually wake up; how long you sleep at a time; how long you are awake each time you wake up; how much total sleep you get each night; and any consequences of this lack of sleep.

Request to see medical if you are experiencing negative effects from the checks or from related lack of sleep. Document in your 602s, your medical visits and your attempts to get medical visits and medical care. Explain what medical did or did not do to help you, or if you were denied medical visits.

If you have submitted 602s in the past about the checks, and the checks are still a problem for you, submit a new 602 (and Form 22) and request to see medical. Please send us a copy of your previous 602 as well.

The PHSS Committee to End Sleep Deprivation and CFASC/Family Unity Network want to help prisoners pursue this grievance. Please send by legal mail a copy of any new 602 (and 22 form) on this issue, any new medical or mental health documents showing that you have submitted a complaint and sought treatment, and any previous 602s you filed on this issue, to:

‘Stop the Torture’ – UN Official Receives Formal Complaint from Solitary Prisoners’ Family Members and Advocates

CA – After months of public outcry, California Families Against Solitary Confinement (CFASC) and the Prisoner Hunger Strike Solidarity Coalition (PHSS) have submitted a formal complaint to Juan Mendez, the UN Special Rapporteur on Torture and Other Cruel, Inhuman, and Degrading Treatment or Punishment condemning the California Department of Corrections and Rehabilitation’s (CDCR) jarringly noisy and disruptive “security/welfare checks” in Pelican Bay State Prison’s Security Housing Units (PB-SHU). These checks, which started on August 2, 2015, have deprived the prisoners of sleep for eight months, amounting to what is widely recognized as a form of torture. The complaint was submitted last week, on Thursday, March 24.

 

One prisoner recently stated that being in PB-SHU with these checks “is like a construction site all night. It is horrible. It really is torture.”  Another wrote, “For decades, military and police forces have used extreme isolation, sleep deprivation, and constant banging/noise to cause mental/physical torment and try to break a person’s mind or human will to resist questioning. These are so-called clean torture methods.”

 

The complaint to Mendez includes reports from interviews with PB-SHU prisoners conducted over a six-month period by Carol Strickman, Staff Attorney at Legal Services for Prisoners with Children.  Additionally, Mendez was provided with statements by sleep experts Dr. Thomas Roth and Dr. Jamie Zeitzer, by psychiatrist Dr. Terry Kupers, and by the American Public Health Association’s Jail and Prison Health Committee about the impact of sleep deprivation on mental health – all who have condemned the “security/welfare checks.”  Internationally recognized sleep expert Dr. Zeitzer explains in his October 2015 report, “The negative health consequences of inadequate sleep have been extensively documented and nowhere in the literature is there a report on as severe a disruption in sleep as is occurring in the Pelican Bay SHU.”

 

“My son doesn’t have the energy to exercise, write, or draw nearly as much since the checks started. He used to write me letters 2-3 times a week; now maybe once a week, and only a few lines,” says Grace A., a member of CFASC and whose son is in PB-SHU. “He has hardly been able to sleep since early August, but is fighting to stay strong. I tell him ‘You are not alone.’”

The Coalition for Effective Public Safety – CEPS is engaging in public actions the 23rd of each month to bring attention to the 80,000+ people held in solitary confinement across the U.S. on any given day and to end solitary confinement. This date emphasizes the 23 or more hours every day that people are kept in solitary confinement. Prisoner Hunger Strike Solidarity Coalition (PHSS) has helped launch statewide Coordinated Actions to End Solitary Confinement in California following the Pelican Bay hunger strike initiated in 2013 by people incarcerated there in response to the deplorable conditions they were being held in. Monthly actions began in California in March 2015, and we started here in Massachusetts in June 2015.

Massachusetts is one of only three states where prisoners who commit disciplinary infractions can be placed in solitary confinement for up to ten years, even though the United Nations Special Rapporteur on Torture has called for a ban on any solitary confinement that lasts longer than fifteen days.

CHICAGO, ILLINOIS:
The Illinois Department of Corrections (IDOC) estimates that 2,500 – 3,000 people are held in solitary confinement in Illinois on any given day. The Federal Bureau of Prisons plans to open Thomson Supermax Prison in Thomson, IL by the end of the year, bringing 1,500 new solitary cells to the state.

The United Nations considers solitary confinement beyond 15 days torture and has called for its absolute prohibition. Many people in Illinois and throughout the US have spent decades in solitary. We say NO MORE.

All those opposed to solitary confinement are invited to rally on July 23rd outside the Thompson Center, home of IDOC before marching to the Federal Building. We demand an end to the torturous practice in Illinois, by both the state and federal government. We demand that the Illinois legislature hold a hearing to investigate solitary confinement, or what they call “Segregation” or “Administrative Detention”. We demand Thomson close its doors, as Tamms did 2.5 years ago.

This action is in solidarity with anti-solitary activists in California who have been organizing actions, events, teach-ins, and more on the 23rd of every month as part of a statewide campaign to end solitary confinement. They’ve chosen the 23rd of the month because people held in solitary spend at least 23 hours/day in isolation.

Two years have passed since people confined in California’s Pelican Bay State Prison initiated (on July 8) a 60-day hunger strike to protest the conditions associated with the prison’s “security housing unit,” or SHU.  Four years have passed since the initial hunger strike began on July 1.

The California Department of Corrections and Rehabilitation (CDCR) continues to claim that “there is no ‘solitary confinement’ in California’s prisons and the SHU is not ‘solitary confinement,'” but people inside the Pelican Bay State Prison’s security housing unit say they remain locked in for at least 23 hours per day.

Every day in New York prisons and jails, there are more than 5,000 people in solitary confinement and other forms of extreme isolation. Working during the day? Meet us at 5:30pm at Coolidge Corner in front of Coolidge Corner Theatre. We’ll chalk facts about solitary confinement up and down Beacon and Harvard!

Massachusetts is one of only three states where prisoners who commit disciplinary infractions can be placed in solitary confinement for up to ten years, even though the United Nations Special Rapporteur on Torture has called for a ban on any solitary confinement that lasts longer than fifteen days.

ARCATA / MANILA, CA:
We will be gathering at the Manila Community Center in solidarity with the other statewide coordinated actions that are happening on the 23rd of every month.  Solitary confinement is rampantly used in California. We are a part of a prisoner-led movement including: family and loved ones of incarcerated people, students, lawyers, youth, teachers, doctors, activists, international and national organizations.

There are people of all ages and genders that are locked in solitary confinement, some for DECADES. With Pelican Bay, a notorious torture chamber, so close… come on May 23rd and help STOP THE TORTURE. You can help us pass out literature, get more involved in the struggle, show your solidarity, or just learn.  We will have an educational demonstration while people are waiting for the Kinetic sculptures in Manila.

In juvenile facilities across California, children are held in solitary confinement for days, weeks, and months at a time. This unnecessarily harsh disciplinary practice harms young people and exposes them to a lifetime of psychological and developmental trauma.

At this event, we will present “If the SHU Fits-Voices from Solitary Confinement”, and follow with a session to:  * Share Stories  * Discuss Strategies to make meaningful change * Take Action!

Find out about SB 124 (Leno), which takes California in the right direction by placing limitations on the use of solitary confinement in juvenile justice facilities and encouraging them to explore more positive and developmentally appropriate methods for working with youth.

Every week The Bay Area Solidarity Committee for Jalil Muntaqim hosts a Political Education Class “New Afrikan Prisoner Writings Study Sessions” from 5:30-7:30PM.  We will dedicate the April 23rd session in solidarity with the prisoner hunger strikers.  We will be reading and discussing “the five core demands” as well as the “Agreement to End Hostilities“.  We will also be dissecting different writings by Abdul Olugbala Shakur, Chairman & founder of George Jackson University. The event, hosted by The Bay Area Solidarity Committee For Jalil Muntaqim and George Jackson University, will end in an open mic and political hip hop Show.
